Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Misar AI Technology Pvt. Ltd. ("Company", "we", "us") governing your access to and use of Misar Social at post.misar.io.

By creating an account or using the service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the service.

Eligibility

You must be at least 18 years old to use Misar Social. By using the service, you represent that you meet this requirement. If you are using the service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials.
You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
You are responsible for all activity that occurs under your account.
You may not share your account with others or transfer it to another person.

Acceptable Use

You agree not to use Misar Social to:

Send spam, unsolicited bulk messages, or engage in inauthentic engagement activity on social platforms.
Post content that is illegal, defamatory, harassing, or violates any third-party intellectual property rights.
Violate the terms of service of any connected social platform (X, LinkedIn, Instagram, etc.).
Attempt to reverse-engineer, scrape, or abuse the service's APIs or infrastructure.
Use the service to facilitate money laundering, fraud, or any other illegal activity.
Impersonate any person or entity or misrepresent your affiliation.

Content Ownership and Licence

You retain full ownership of all content you create using Misar Social — including posts, drafts, images, and AI-generated variants.

By using the service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely as necessary to provide the service (e.g., to schedule and publish posts to your connected accounts). This licence terminates when you delete the content or close your account.

You are solely responsible for ensuring your content complies with the terms of each connected platform and applicable law.

AI-Generated Content Policy

Misar Social uses artificial intelligence to assist in drafting social media content. AI-generated output may contain inaccuracies, errors, or content inappropriate for your brand.

You are responsible for reviewing and approving all AI-generated content before publishing. We recommend enabling the approval workflow (Settings → Approvals) so no content is published without human review.

We do not make any warranties about the accuracy, suitability, or quality of AI-generated content.

Payments and Subscriptions

Paid plans are billed through Stripe. All billing is handled by Assisters LLC (a Delaware, USA corporation) as the merchant of record.
Month-to-month plans may be cancelled at any time; access continues until the end of the current billing period. No refunds are issued for partial months.
Annual plans are billed upfront and are non-refundable except as required by applicable consumer protection law in your jurisdiction.
We reserve the right to change pricing with 30 days' advance notice. Price changes take effect at your next renewal date.
Failed payments may result in a brief grace period; if payment is not resolved, the account may be downgraded to Free.

Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance windows, infrastructure incidents, and third-party API outages (social platforms, GitHub) may cause temporary unavailability.

Termination

You may close your account at any time from Settings → Account → Delete Account.

We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to the service or other users. We will provide notice where reasonably practicable, except in cases of serious violations.

Disclaimers and Warranties

Misar Social is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be error-free, uninterrupted, or that AI-generated content will meet your requirements.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.

Our total cumulative liability to you for any claims arising out of or relating to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India, without regard to conflict of law principles.

Dispute Resolution

Before initiating formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. We will try to respond within 14 business days.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or dashboard notification at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the new Terms.
